본 연구는 학교 교육과정의 편성운영권과 교장의 직무 권한과의 관계를 다루면서 학교 수준의 교육과정에서 논의되어야 할 사항을 제시하는데 목적을 두고 있다. 이 목적을 위해, 우선 교장의 지위와 직무상의 권한을 다루었다. 교장은 행정가와 교육자로서의 직무상 권한을 동시에 지니면서, 학교의 의사 표시를 대내외적으로 대표하는 지위에 있었다. 다음으로 법적인 측면에서 교육과정은 의미론적 규정이 아닌 평성에 대한 권리나 권한의 문제로 이해되어야 함을 밝혔다. 그리고 교육과정 편성운영의 주체는 단위학교에 주어져 있고, 국가와 지역 수준에서는 이에 대한 기준과 내용의 기본적 사항을 제시하는 역할을 수행함을 밝혔다. 마지막으로 교육과정 편성운영과 교장의 관계를 학교교육과정의 법적 근거, 주체, 교장의 자격, 교장의 역할과의 관계로 나누어 개관하고, 학교 내 교육과정 주체의 문제를 보다 깊게 다루기 위해 논의되어야 할 사항을 제시하였다.
Abstract
This study inquires into the relation between the rights for the organization and implementation of the school level curriculum andauthority of the principal. and it suggests the necessity for the issues in school level curriculum. The things that are discussed and follwings. First, it discussed the legal status and the authority of the principal. The principal holds the authority for the organization and implementation of the curriculum is and educatior as well as an administrator that manages the school. But he should not intervene but support teaching activities of teachers. Second, it discussed the organization and implementation of the school level curriculum. The meaning of curriculum in the science of law is regarded as the rights for the organization of the curriculum, not the meaning of curriculum in education. Schools have the rights for the organization of the curriculum under the operative law. Third, it observed the relationship between the rights for the organization and implementation of the school level curriculum and the authority the principal. It deals with legal ground for the school level curriculum, the subject of the rights for the organization of the school level curriculum, and qualification of the principal, and the role of the principal.
