Abstract

I analyzed the issue of related law on labor time in primary and secondary schools and suggested the idea for making law. At present, teachers work 8 hours including lunch time but staffs work 8 hours excluding lunch time. 15 local assemblies revised the ordinance to make the teacher's labor time and staff's one same. But government made authoritative interpretation that change of the labor time doesn't mean the change of quantity of time but the time zone. Many countries recognize teachers' lunch time labor time because teachers teach pupils in lunch time. I suggested a few analysis results. Firstly, labor time includes time zone and time quantity. Secondly, lunch time can be recognized labor time. Thirdly, teachers' and staffs' working activities have the similarities and differences. Fourthly, making change labor time by ordinance has illegality. So, I suggested that we should apply school labor time the present rules of 'field work official' or make law of the flexible operation of the lunch time.
