1954년 미국 연방대법원은 “공립학교에서 분리하되 평등한 원리(doctrine ofseparate but equal)는 위헌이며, 분리된 학교시설은 본질적으로 불평등하다”는 요지의 브라운 판결을 통해 흑백분리학교의 통합을 명령했다. 금년 60주년을 맞이한 브라운 판결은 그동안 학교교육의 영역만이 아니라 정치, 경제, 사회, 문화, 예술, 스포츠등 미국 사회의 전반적인 영역에서 사회시스템을 리모델링하는 법률적 준거로서 역할을 수행해 왔음을 알 수 있었다. 이에 본 논문에서는 60년을 맞이한 브라운 판결의 유산과 과제를 탐색하고 저출산과 고령화, 그리고 글로벌 환경 변화에 따른 외국계 이주자의 증가와 함께 빠른 속도로 다문화, 다인종, 다양화 사회로 이행되고 있는 우리나라와 관련된 시사점도 살펴보고자 했다. 연구 결과에 따르면, 브라운 판결의 유산은교육적 측면에서 흑백통합학교의 증가 및 고등교육기관에서 소수자우대정책(Affirmative Action Policy)의 시행, 사회적 측면에서 구직, 금융 서비스, 주택구입등에서 불이익 해소를 통한 흑인의 권익신장, 그리고 법률적 측면에서 민권법, 투표법등 차별금지 및 기본권 보장과 관련된 법률 제정 등으로 정리할 수 있었다. 향후 과제로는 흑백통합의 양적 측면에서 질적인 측면으로 관점 전환, 라틴계의 인구 증가에 따른 정치적 역학 관계의 설정, 대학의 소수자우대정책에 대한 새로운 접근방식이 요구되었다. 이를 토대로 다문화 사회로 급속히 이행하고 있는 우리나라에 브라운 판결을접목시켜보면, 차별과 불평등의 걸림돌 제거, 할당제 및 가산점 등 우대 정책의 신중한 선택, 소수자가 아닌 다수자를 위한 다문화교육 시행 등으로 그 시사점을 찾을 수있었다.
Abstract
On May 17, 1954, the U.S. Supreme Court delivered the opinion, stating that “We conclude that inthe field of public education the doctrine of ‘separate but equal’ has no place. Separate educationalfacilities are inherently unequal.” For the last six decades this landmark case named Brown decisionhas been cornerstone for changing all areas of American society. The Brown case was a landmarkUnited States Supreme Court case in which the Court declared state laws establishing separatepublic schools for black and white students to be unconstitutional. The unanimous decisionoverturned the Plessy decision of 1896, which allowed state-sponsored segregation, insofar as itapplied to public education. This ruling paved the way for integration and was a spark to theAmerican civil rights movement. The Brown case has made many kinds of legacies as well as tasks in the American modernhistory. Today desegregation and equal educational opportunities for black people are indebted to theBrown case. Also the Brown case sets tasks concerning quality-control problem of integration andnew approach for fulfilling Affirmative Action at higher education institutes.
