Board of Education, 347 U.S.
Abstract
「The Special Education Act for the Disabled」 defines integrated education as "undiscriminatory and appropriate education for individual educational needs with peers," emphasizing that "education with peers" is an educational method that allows disabled students to recognize that they are not discriminated against by disabilities and further grow into equal members of society. It is interpreted that integrated education is set as the ultimate goal of special education. The study found the origins of the schematic ‘equality = integration’ and ‘discrimination = separation’ in the Brown v. Board of Education (347 U.S. 483) case of the United States Supreme Court. In the Brown case, the U.S. Supreme Court completed the "School Integration = Educational Equality" scheme, which concluded that school segregation hurts the self-esteem of minority children, and the legitimacy of integration in the civil rights movement against racism began with a focus on good as a norm in the area of disabled rights. Advocates of the rights of disabled students have promoted integration as a means of liberating disabled students from under-standard specialized schools. Currently, the core of the 「Individuals with Disabilities Education Act(IDEA)」 is to require disabled students to be educated in the least restrictive environment. However, the IDEA establishes legal remedies that appear to weaken the requirements of the least restricted environment, adding to confusion regarding the appropriate interpretation of the requirements of the least restricted environment. From a principled point of view, our reality of special education makes the expansion of special schools a top priority task. If it is difficult to focus on special schools, of course, the increase of special teachers and the expansion of special classes for integrated education should be made quickly. It is said that a decrease in the school-age population is an obstacle to increasing the number of special education personnel, but it should not have to be the problem. The birth rate is falling, but the aging population is accelerating. The expanded special schools and increased special education personnel can be converted to facilities and manpower for the welfare of the disabled seniors. At a time when the aging population is accelerating, the improvement of elderly care institutions will soon receive attention as an urgent national responsibility. Prescriptions that solve the current problem should serve as prescriptions to solve future problems.
