해외 직업법령 비교를 통한 국내 심리상담 법제화 방향성 탐색

본 연구에서는 2022년 3-7월 발의된 국내 심리상담 관련 법안들과 해외의 법령을 비교하여, 이미 여러 직역이 심리상담 관련 서비스를 제공하고 있는 현 상황에서 심리상담 관련 법이 어떻게 제정되는 것이 바람직한지 알아보고자 하였다. 먼저 국내 발의법안들을 비교하여 심리상담 관련 직역 간 분리 혹은 통합의 방향성이 드러나는지 비교하였다. 그 결과, 심리사를 규정하는 법안과 (심리)상담사를 규정하는 법안 간의 차이가 업무영역의 차원에서는 뚜렷하지 않았고, 최소 응시자격의 수준에서 나타나 두 직역 간 분리가 명확하지는 않았다. 이어서 해외의 직역 간 개별, 분리, 혹은 통합 법제화 사례와 그 결과를 알아보았다. 이를 위해 하나의 심리상담 관련 직역만이 법으로 규정된 국가(말레이시아, 일본, 독일), 심리사와 상담사 각각 법이 존재하는 국가(미국), 하나의 법에 두 개의 자격이 존재하는 국가(대만)의 사례를 살펴보았다. 이를 통해 거시적 차원에서 통합 혹은 분리된 법제화가 가져온 예상치 못했던 사회적 부작용과 직역 간 견제와 갈등과 같은 결과들을 살펴볼 수 있었다. 이를 바탕으로 우리나라의 심리상담 법제화에 주는 함의를 논의하였다.
Abstract
This study compared the bills for psychologist, counselor, and psychological counselor proposed in March-July 2022 with the laws enacted in other countries to determine the direction of the law on psychological counseling in Korea. At first, the proposed bills were compared to examine whether they revealed a direction of separation or integration between counseling-related professions. Results showed that there was a difference in the minimum level of qualification for application but little difference in the description of the role of each profession in the proposed bills. In other words, the difference in roles between psychologist and (psychological) counselor was not signified by the contents of each bill. Next, foreign laws and their consequences were reviewed with regard to the separation or integration of professions: the countries with a single law (Malaysia, Japan, and Germany); a country that legislated two laws for psychologists and counselors, respectively (the United States); and a country that divided psychologists into clinical psychologists and counseling psychologists in a single law (Taiwan). The analyses revealed that there were unexpected side effects and conflicts between professions in those countries. Based on the findings, the implications for the legislation for psychological counseling in Korea were discussed.
