중국공산당 18대 당대회에서 “해양강국의 건설”은 국가전략으로 격상되었다. 2013년 중국 국무원의 “대부제(大部制)” 행정개혁안에서는 분산된 해상집법(海上執法) 부문을 통합하고 국가해양국(国家海洋局)을 개편하며 해경국(海警局)에서 해상집법을 통일적으로 수행하기로 정하였다. 이는 중국 해상집법체제에서의 역사적 전환으로서 중국 해양사업발전역사에 있어서 이정표적 의의를 가지고 있다. 이번 구조조정은 해상집법체제의 중대개혁의 시작으로서, 향후 제 법률문제와 현실적 도전에 직면할 것이다.
Abstract
“Build China into a maritime power” has been established as an important national development strategy by the 18th National Congress of the Communist Party of China. And it also insists the importance of safeguarding China's maritime rights and interests. “Plan for the Institutional Restructuring of the State Council and Transformation of Functions” integrates the decentralized maritime law enforcement agencies so as to build an unified maritime law enforcement system. This is not only a historic turning point of Chinese maritime law enforcement system, but also a landmark event in the history of marine development of China. However, as a major reform of maritime law enforcement system, the institutional restructuring is only a start. There are still many legal issues and challenges.
