中國의 海上執法體制에 관한 硏究

“유엔해양법협약”의 발효는 국가해양권익의 확대는 물론 각국의 관할해역에 대한 종합적인 관리를 요구하였다. 그러나 중국은 오랫동안 해양행정관리와 해상집법체제의 분산으로 기존의 해상역량 특히 해상집법역량은 날로 확대되는 국가주권과 해양권익의 요구를 충족시키지 못하고 있다. 따라서 본 연구에서는 주요 해양국의 해상집법체제를 고찰하고 현재 우리나라 해상집법체제의 각 문제점과 폐단을 분석한 후, 해경을 중심으로 한 통일적인 해상집법체제의 구성안을 제시하였다.
Abstract
“U.N. Convention on the Law of the Sea” magnifies the national sea rights and interests, demands all of the countries implement the integrative supervise. However, over a long period of time our system of marine administration and law enforcement is heavily dispersed. The force at sea , especially the force of the marine law enforcement can not meet the needs of maintaining the state sovereignty and national sea rights and interests. This paper researches the marine law enforcement system of primary oceanic nation, expounds the problems and abuse which lies in the marine law enforcement system of china, bring forward the suggestion of establishing the force which is mainly made up of policeman at sea to unify the marine law enforcement system of china.
