Abstract

Korea concluded its first bilateral investment treaty with Germany in 1964. Since then, Korea has signed more than one hundred bilateral investment treaties and investment chapters in FTAs. This paper traces the evolution of the Korean Government’s investment treaty policies, focusing on the motivations behind the treaties. In the 1960s and 1970s, Korea was motivated to sign BITs with major developed countries by a desire to enhance diplomatic ties and to obtain supports for economic development. The intrinsic benefit of investment treaty, attraction of foreign direct investment, received only minor attention. Over the decade from the mid-1980s to the mid-1990s, Korea has become a capital surplus economy and actively concluded BITs with less developing countries and transitional economies. Learning experience from the BITs with developed countries was adapted to the Korea’s position as an advanced developing country. Economic diplomacy was a major driving force behind those treaties. It was not until the late 1990s, when the Korea economy was hit by a financial crisis, that the Korean Government approaches investment treaty as a tool in the competition for foreign direct investment. Korea sought competitive advantage through the adoption of high-standard investment treaties including obligations of investment liberalization. The potential sovereignty costs of investment treaties have not been seriously considered before the FTA negotiation with the US in 2006. Learning from the experience of other countries hit by investment treaty claims, Korea was motivated to seek more legal precision. The main aspect of policy considerations shifted from diplomacy to economy and then to law. This paper argues that major hypotheses on investment treaty adoption by developing countries are not well-suited to the Korean case because Korea has been ahead of most other developing countries in adopting the treaties.
