중국의 신(新)수출통제제도에 관한 연구 - 한국과의 비교를 중심으로 -

Abstract

On October 17, 2020, the Standing Committee of the National People's Congress passed the Export Control Law with the goal of strengthening export controls to fulfill international obligations and protect national security and national interests. The Export Control Law is significant because it is the first comprehensive export control law enacted by the Chinese government. As The Export Control Law expands and strengthens the scope of export control, the scope of punishable illegal acts and targets, and the degree of punishment. it is predicted that risks of Korean foreign-invested companies will increase. This study reorganized Chinese new export control system in contrast to the export control system that were scattered in the past. This paper analyzes how the contents of the new export control system differ from Korea's current export control system. This study analyzed China’s new export control system and derived the following implications. Legislatively, Korea needs to enact the Basic Export Control Act like China to systematically and comprehensively manage export control. From a policy perspective, scenario-specific response plans to China's export control measures and non-export control measures are urgently needed. The reason is that China can cause enormous damage to Korean industry at any time through not only export control measures but also non-export control measures. Furthermore, institutionally, just as China's Export Control Act provides the basis for establishing an export control expert advisory system, Korea also needs to establish an export control expert advisory system to approach export control scientifically.
