수출통제법제 이행강화의 측면에서 본 개정 「대외무역법」 평가와 과제

2024년 8월 21일 개정 「대외무역법」이 시행되었다. 동 개정은 무역안보 환경변화와 국제적인 수출통제 강화 추세를 고려하여 수출통제 집행 강화와 국제공조 체제 구축을 목표로 한다. 이번 「대외무역법」의 개정은 일부개정의 형식이지만, 전략물자 수출통제 제도 분야는 사실상 전면개정이라고 얘기해도 무방할 정도로 내용뿐만 아니라 편제도 대폭 개정되었다. 그동안 선행연구에서 주장되었던 수출통제법제의 개정 제언의 내용도 상당부분은 반영되었다는 점에서 이번 개정은 긍정적으로 평가된다. 본 논문은 제도 분야, 집행 분야, 기구 및 조직 분야별로 개정이 이루어진 법제를 분석하여 개정 「대외무역법」의 의미를 평가한다. 이번 「대외무역법」 개정은 수출통제법제 이행강화에서 긍정적인 효과가 기대되지만, 한편으로는 수출통제법제 이행강화를 위해 개선되어야 할 내용도 여전히 존재한다. 본 논문에서는 최근 개정된 「대외무역법」에서 추가 개정의 필요성이 있다고 판단되는 내용들을 입법안으로 제안함으로써 수출통제법제의 이행 및 집행강화에 기여하고자 한다. 특히 동 연구에서는 개정의 필요성에 대한 문제분석 및 제언으로 그치지 않고 입법개정안을 명확하게 제시하였는데, 동 내용을 토대로 개정의 필요성에 대한 후속 논의가 활발히 진행되기를 기대한다.
Abstract
The amended Foreign Trade Act went into effect on August 21, 2024. Given the evolving trade security landscape and the move toward more stringent international export controls, the amendment seeks to fortify export control enforcement and create a system of international cooperation. Even if the Foreign Trade Act has undergone a partial reform, the structure and content have undergone major changes, making the export control system for strategic goods essentially a complete overhaul. The idea for change of the export control legislation, which was supported in the earlier studies, has been mostly represented in this revision, which is a good evaluation. By examining the updated law in every system, institution, enforcement, and organization, this essay assesses the importance of the revised Foreign Trade Act. Although it is anticipated that the modification of the Foreign Trade Act will tighten the application of the export control laws, several contents still need to be changed in order to improve their efficacy. In order to aid in the implementation and enforcement of export control laws, we suggest in this paper that the newly updated Foreign Trade Act be further revised. Specifically, this paper clearly described the legislative amendment in addition to analyzing the issue and suggesting revisions. Given the foregoing, it is anticipated that active follow-up conversations regarding the need for change will take place.
