국내산업 확립의 실질적 지연 관련 반덤핑 조사 실무 연구 - 한국과 미국 비교를 중심으로 -

Abstract

The WTO Anti-Dumping Agreement allows importing countries to impose anti-dumping duties when the establishment of a domestic industry is materially retarded by dumped imports. It, however, does not specify specific criteria for determining such type of injury, leading each country to establish and apply their own domestic rules and investigation practices. Considering recent trends towards reshaping supply chains centered on domestic interests and efforts to foster domestic industries, policymakers need to devise sophisticated methodologies to promptly remedy an injury caused by unfair trade practices such as dumping, not only for established industries but also for those not yet established. This study aims to provide policy strategies in administering anti-dumping system related to the 'material retardation in establishing a domestic industry' in South Korea by comparing and examining actual cases of South Korea and of the United States. It also seeks to derive policy recommendations for matters requiring special consideration to align current anti-dumping norms and investigation practices with the purpose of determining the material retardation.
