본 논문은 한국과 일본이 旣체결한 자유무역협정(FTA)의 반덤핑규정을 비교분석하고, 한국-일본 FTA 협상을 위한 정책적 시사점을 제공하고자 한다. FTA에서 합의가 이루어지고 있는 반덤핑규정은 (1)WTO 반덤핑협정을 대부분 준용하는 유형(WTO-equivalent), (2)WTO 반덤핑협정을 기초로 하여 반덤핑조치의 발동에 필요한 절차적 내지는 실체적 요건들을 강화하는 유형(WTO-plus), 그리고 (3)역내국간에 반덤핑조치의 적용을 배제하는 유형으로 구분할 수 있다. 양국의 旣체결 FTA를 분석한 결과, 한국은 WTO-plus 유형의 반덤핑규정을 도입하여 반덤핑조치의 발동요건을 강화하거나 제도남용을 방지하기 위하여 노력하고 있다. 하지만, 일본은 WTO-equivalent 유형의 반덤핑규정으로 일관하고 있으며, WTO 다자간협상에서의 정책적 방향성과 상반된 모습을 보이고 있다.
Abstract
This paper examines antidumping provisions in the FTAs of Korea and Japan. According to the previous researches, we can classify FTAs into three mutually exclusive groups: (1)those that prohibit the use of antidumping measures, (2)those that include some procedural and/or substantive requirement for antidumping measures, and (3)those that have no such prohibition and no specific provisions. The results of this paper found that Korea is adopting ‘WTO-plus’ provisions, additional rules regarding the application of antidumping measures, in their FTAs. In contrast to the Korean policy, Japan’s FTAs are maintaining rights to impose antidumping duties in accordance with GATT Article Ⅵ and WTO Antidumping Agreement, which are ‘WTO-equivalent’ provisions.
