중국의 반덤핑 산업피해조사규정에 관한 통상법적 고찰

본 연구의 목적은 중국의 반덤핑규제가 우리나라에 집중되고 있는 상황에서 자의적인 해석이 가능한 반덤핑 산업피해조사규정에 대한 통상법적 고찰을 통해 중국 반덤핑 산업피해조사규정의 문제점을 파악하고 이의 대응방안을 제시하는데 있다.중국에서는 반덤핑 산업피해조사의 규범화를 위해 중국의 반덤핑조례에 근거하여 반덤핑 산업피해조사와 판정규정(2002년)을 제정하였고 이를 개정하여 반덤핑 산업피해조사규정을 2003년 11월 17일부터 시행하고 있다.그러나 개정된 반덤핑산업피해조사규정은 구규정에 비해 많은 조항이 삭제되어 오히려 자의적 해석의 가능성이 높아져 남용의 소지가 많아 비관세장벽의 역할로 작용될 가능성이 높다고 판단된다.
Abstract
This study is to find out problems of regulations of anti-dumping investigation into industrial injury of China and suggest ways how to solve the problems through research of trade law in relation with regulations of anti-dumping investigation into industrial injury, which are likely to be interpreted literally in the situation where anti-dumping restrictions of China are being concentrated on Korea.In 2002 China enacted regulations concerning anti-dumping investigation into industrial injury and criteria for judgement on the basis of its own anti-dumping regulations in order to establish practices of anti-dumping investigation into industrial injury and has amended and implemented the regulations of anti-dumping investigation into industrial injury since November 17, 2003. However, it is considered that there is more likelihood to use the regulations as Non-Tariff Barriers(NTB) and to interpret them literally because many articles found in the original were deleted in the process of amending regulations of anti-dumping investigation into industrial injury.
