본 글의 주된 목적은 헤겔의 사적 소유 이론의 특성과 그 한계를 살펴보는 것이 다. 헤겔의 사적 소유 이론의 독특성은 근대 사적 소유 이론의 다양한 흐름을 체계적으로 종합하는데 있다. 헤겔은 인간을 사적 소유주로 행동할 수 있는 인격적 존재로 파악한다. 그는 사적 소유의 필연성을 경험적인 방식으로 형성된 사람들 사이의 동의에서 구하지 않는다. 그는 사적 소유의 필연성을 자유와의 연관성에서 해명하고자 한다. 즉 헤겔은 사적 소유가 인간의 자유 실현의 필연적인 한 계기라는 점에 그 정당성이 존재한다고 주장한다. 그런 점에서 헤겔은 원칙적으로는 칸트의 후예이다. 그렇지만 헤겔의 소유이론은 좀 더 포괄적이고 종합적이다. 그는 자유의지 이론적 맥락에서 로크적인 노동 이론적 관점과 점유취득적인 이론을 받아들여 근대에서 등장한 여러 사적 소유 이론의 종합을 시도하기 때문이다. 헤겔 소유이론의 종합적 성격에도 불구하고 그것이 안고 있는 문제점들도 적지 않다. 본 글에서 필자는 특히 인격과 물건의 이원성, 사적 소유의 범위 설정의 문제 그리고 경제적 불평등의 문제 등과 연관해서 헤겔 소유 이론이 안고 있는 문제점들을 지적하였다.
Abstract
The main Purpose of the essay consists in analysing the features and the limits of Hegel's theory of private property. Hegel's theory of property contains the original characters, because it synthesizes modern diverse theoretical standpoints about the private property. Hegel maintains that the legitimity of the private property lies in the fact that it is one of necessary conditions for the realization of the freedom of human beings as persons. He considers that a human being is a person, who can act as a owner. He will explain the necessity of the private property in its connection with the concept of freedom. Therefore Hegel is a successor of Kant. But Hegel's theory is more comprehensive and synthetic, because he tries to synthesize Locke's theory of property and the theory of taking possession in the context of the theory of free will. Despite of the synthetical feature of Hegel's theory it contains several problems. In this essay I try to make it clear that there are various limits in Hegel's theory of private property with regard to the dualism of person and thing, the unlimited recognition of the private property and the economic inequality.
