원산지란 특정 물품이 생산된 국가 또는 지역을 말한다. 원산지 표시는 국가브랜드가 높은 나라의 수출경쟁력 강화, 수출입 상거래질서 확립 및 생산자와 소비자의 권익보호 등의 원산지표시의 기능과 역할을 하는바, 이 표시규정을 위반하게 될 경우 그 영향은 크고 중대하게 나타난다. 본 연구에서는 수입물품과 시중유통단계에 있는 물품에 대한 원산지표시를 규정하고 있는 법률 중 대외무역법, 농수산물의 원산지 표시에 관한 법률 및 관세법 등 3가지를 중심으로 내용을 분석하고, 이들 법령을 위반하는 경우 행정벌과 형사벌 등을 포함하여 어떠한 제재가 과해지는가를 검토하였다. 또한 물품의 원산지표시위반 현황 및 그 시사점을 살펴보았다. 또한 원산지표시위반행위를 효과적으로 억제하기 위해서는 원산지표시 위반에 대한 처벌의 강화, 적발확률의 제고, 단속활동의 강화, 단속요원의 확충, 단속정보의 공개, 포상금제도의 활성화, 원산지표시제도의 홍보와 교육을 통한 의식의 전환 등 다양한 방안이 필요하다는 점을 제시하였다. 본 연구는 관세청 등 관련 기관이 원산지표시위반행위를 사전적으로는 예방하고, 사후적으로는 적발하기 위한 방안을 강구하는 데 도움이 될 것이라고 생각한다.
Abstract
The country of origin stands for country or area where a specific product had been manufactured. As the country of origin labeling performs its functions and roles such as consolidating export competitiveness of a country with high national brand, establishing import/export commercial trade order as well as protecting the rights and interest of manufacturers and consumers. In case of breaching this labeling regulation, the effect is greatly and severely shown. In this study, the details have been analyzed based on 3 types of laws including Foreign Trade Act, Act on the Country of Origin Labeling of Agricultural Products and Customs Act among the laws regulating the country of origin labeling on the imported products and the products at the distribution stage on the market to examine what types of sanctions are imposed including administrative punishment and criminal punishment in case of breaching these laws. Also, the country of origin labeling breach status of products and its implications have been examined. In this study, the fact that plans such as consolidation of punishment on the breach of country of origin labeling, raise of prosecution probability, consolidation of crackdown activity, increase of crackdown personnel, promotion of reward system, disclosure of crackdown information along with the change of awareness through publicity and training, etc are necessary as plans to effectively control such breach of place of origin labeling has been presented.
