환경분쟁 해결을 위한 징벌적 손해배상제도 도입에 관한 고찰

환경분쟁이 갈수록 다양한 형태로 발생하고 그 중요성이 커지고 있다. 환경분쟁을 해결하기 위한 다양한 제도가 연구되고 있다. 그 중 하나가 영미법계 국가에서 운용되고 있는 제도로 악의적인 불법행위에 대한 응징을 강조하는 징벌적 손해배상제도이다. 징벌적 배상제도에 악의적인 불법행위를 억제하는 예방적 효과가 있고 이에 대한 이론적 근거를 제시하기 위한 연구도 있다. 대륙법계 국가로 민사책임과 형사책임을 준별하는 우리나라에서는 징벌적 손해배상제도를 원칙적으로 인정하지 않으므로 외국판결의 승인문제가 있다. 그럼에도 불구하고 우리나라에서 사법개혁추진위원회의 징벌적 손해배상법안에 관한 논의가 있었고, 하도급법에서 악의적인 가해자에 대한 징벌적 손해배상제도가 도입되었으며 경제민주화를 이유로 그 개정안이 제출되어 있다. 징벌적 손해배상법안에 환경부분이 포함되어 있었던 것을 감안하면 환경분쟁의 해결을 위하여 징벌적 손해배상제도를 도입해야 할 필요성에 대한 보다 적극적인 논의가 필요하다. 징벌적 손해배상제도 도입에 관한 유용성을 법경제학적 또는 법심리학적 시각을 검토한다. 실손해의 수십 배를 배상하게 할 수 있는 미국의 징벌적 배상 제도를 중심으로 징벌적 손해배상제도의 기능과 분할회복제도를 중심으로 운영실태를 살펴본다. 사적 형벌이라는 특징을 가지고 있는 징벌적 배상제도가 환경분쟁 해결수단으로서 기능할 수 있는지 여부와 대체적 분쟁해결방안인 환경분쟁조정제도의 유용성을 제고할 수 있는지 여부 및 조정제도의 활성화를 위한 근거로 사용될 수 있는지 여부를 검토한다.
Abstract
Environmental Dispute has been recently increasing and its importance has been serious. There are many studies on the settlement of environmental dispute. One of them is punitive damages system that is applied in anglo-american law system. Punitive damages may be awarded only when the wrong is malicious, and ought to be assessed by the jury in their sound discretion, without bias or feeling according to the malignity shown, and in such reasonable sum as will tend to prevent future evils of like kind and degree. Nowadays punitive damages system is estimated as effective device for deterrence of wrongful behavior. But punitive damages system has not been harmonized in our law system. Recently Fair Transactions in Subcontracting Act has been altered that plaintiff can be awarded in three times of his damages at special wrongful case. Some scholars suggest that punitive damages system should be accepted in our environmental law system. The environmental dispute adjustment committee shall try to execute the procedure for settlement rapidly, fairly, and economically, and the parties concerned who take part in the procedure for settlement shall participate faithfully in that procedure with reciprocal trust and understanding. If punitive damages system were accepted in our environment law system, the environmental dispute adjustment committee will apply it to resolve environmental dispute.
