Abstract
The regulations prohibiting human trafficking in the Chosŏn Dynasty were formally legislated in the Soktaejŏn (續大典) compiled during the reign of King Yŏngjo (英祖) in the eighteenth century. The regulations in the Soktaejŏn that prohibit human trafficking are connected to those that prevent the spread of trafficking on land and sea, as well as to the measures that intensify crackdowns. Human trafficking, which had been revealed since the seventeenth century, or the crime of human trafficking, emerged as a destination for human trafficking not only in Hamgyŏng province (咸鏡道) but also in P'yŏngan province (平安道) during the reign of King Yŏngjo in the eighteenth century. Women and young children lured from Seoul and Kyŏnggi province were trafficked in Hamgyŏng-do or P'yŏngan-do, and during the investigation, the issue of whether or not they were trafficked to Qing people across the border became an issue. Between 1735 and 1741, cases of trespassing were detected, including cases involving women and children, and in November 1747, it was revealed that Samnye (三禮, 參禮) and Soŏp (小業), who had given birth to a child with a Qing person and lived in the Tŭngdŭnggi (登登磯) area on the coast of the lower reaches of the Tuman River (豆滿江), were trafficked to Qing people. At that time, the trafficker took eighteen people to Hamgyŏng through Yi Un'gil (李雲吉, 李云吉), sold sixteen people of them to Hamgyŏng people, and sold two people to Qing people. It is possible that the victims of human trafficking who entered the border areas of P'yŏngan or Hamgyŏng participated in the increasing trend of trespassing between Chosŏn and Qing. The cases of Samnye and Soŏp, although limited, provide an example of movement across the border through human trafficking.
