Abstract

Rationalization of fact-finding process have been and would be one of the main issues in criminal cases. The process of fact-finding could be defined as proper appraisal of probative force of the evidences and obtaining rational inferences therefrom. One of the main topics arising therefrom is the issue of “Probability.” Probability issue seems to be the real highlight of the trial procedure. In some respect, it cannot be exaggerated to say that evidence and fact-finding all boils down to the issue of probability. Although modern day fact-finding process has been improved dramatically than before, with the increase of scientific knowledge and significant breakthrough of criminal investigation technique based on forensic science, it should be admitted that probability issue still plays an important role and will do so. In any and all cases, complicated factual assumptions suggested and derived from authenticated evidences and reasoning procedures leading us into the conclusions, do not always show us simple, orderly and harmonious factual description of the case. More often than not, complex combination of fragmentary factual pieces call individual observer into being tempted to wander around in the maze against their hope rather than get the clear picture and grasp the truth of the case. Here, fact observer tends to be obsessed with some clue and fall into losing his attention and finally let go of the real truth of the case. If the investigators do not fully understand the power and drawback of the “Probability” introducing us into finding the truth or at the same time into becoming blind to the whole truth by hiding it, it should be noted that they are not yet be prepared to deal with the case. Fact-finding in trial case is regarded as a conundrum to trial lawyers, and formulation of theory or systematization of scientific method still remains a tough challenge. Fortunately, however, the issue of probability already had fascinated and drawn attention of numerous Greek Sophists. And deep insights of theirs can provide us valuable implications and precedents to be applied to present day trial case. This research tries to introduce the notion of probability in Classic Age by reviewing on First Tetralogy of Antiphon and tries further to review fact-finding rules of Korean Supreme Court cases.
