Abstract
An Island is defined as a ‘naturally formed area of land, surrounded by water, which is above water at high tide’ in the Article 121(1) of the UN Convention on the Law of the Sea(UNCLOS), and in principle can generate the territorial sea, the contiguous zone, the exclusive economic zone and the continental shelf(Article 121(2)). But rocks which cannot sustain human habitation or economic life of their own shall have no exclusive economic zone or continental shelf(Article 121(3)). Article 121(3), however, does not define what a ‘rock’ is and provide any dividing line between rocks and other islands. In addition, the meaning of ‘human habitation’ or ‘economic life’ is not defined in the UNCLOS. That’s why we need to look at the experience of state practice and the jurisprudence of international judicial courts concerning the status of rocks. The structure of this paper is as follows: after introduction, the second section will explain the legal status of islands and rocks and the difference between them; the third section looks at the international judicial judgments and state practice to examine the role of rocks including small islands in maritime boundary delimitation.
