Abstract
The United Nations Law of the Sea Convention defines an island in Art. 121 (1) as “... a naturally formed area of land, surrounded water, which is above water at high tide and Art 121 (3) as ”rocks which can not sustain human habitation or economic life of their own shall have no Exclusive Economic Zone (EEZ) or Continental shelf. However, this definition is less straightforward than it appears, because it happens to be a variety of interpretation problems on Art. 121. For example, the naturally formed area of land surrounded by water may gain or lose the element of island status due to change in the elevation of the water level and artificial efforts. Even an uninhabited small mid-ocean island without significant economic merits of its own would entitle the owner-state to claim it as its own EEZ. This paper will draw on examples of this phenomenon to how such changes may occur and how the UN Law of the Convention might be applied to these islands(rocks) such as Dokdo.
