Abstract

What should the object and methodology of jurisprudence be? Thus far the so-called “conceptual analysis” of legal “concepts” such as ‘law’, ‘right’, ‘duty’ has been the mainstream methodology in jurisprudence. This method is to rely on analysis and intuition in order to reveal a priori what is deemed to be the essential and necessary elements(e.g., authority, coercion, recognition) of the legal concepts. Naturalization, however, points out the poverty of this method and is proposed as its alternative. That is, naturalization is an approach from “empirical sciences”, in a sense. This paper concerns itself with American legal philosopher Brian Leiter’s theory of naturalized jurisprudence. He shows that not a single but a variety of types of naturalization are available according to the standards of object, dimension, goal and level of the naturalization. This consideration of each standard for characterizing naturalization enables us to see Leiter’s naturalized jurisprudence as a multifaceted but consistent theory of law. The aftermath of this line of understanding strikes us as rather interesting. On the one hand, His proposal for naturalization as a replacement of analysis and intuition with empirical science is quite ambitious as such. On the other, however, his approach is rather careful: he does not try to use this scientific method to answer the traditional questions of jurisprudence such as what the nature of law is and what exists with respect to law, nor does he try to rely on any fundamental science prior to folk science. Thus, simply put, Leiter’s naturalization is comprehensive and ambitious in its motivation but still careful and limited in its practice.
