Abstract
Amid a recent surge in the use of brake-less fixed-gear bicycles (“fixies”) among adolescents in Korea, public concern over traffic safety has intensified. A fatal incident involving a middle-school student riding a brake-less fixie triggered nationwide debate and prompted the Korean National Police to apply Article 48 of the Road Traffic Act as a legal basis for enforcement. However, this approach—extending existing provisions to a novel vehicle type—reveals limits in legal clarity and normative fit. Although the risks of brake-less fixies have been repeatedly highlighted in media reports and internal police guidance, official traffic-accident statistics do not separately classify or compile this type, making it difficult to quantify the scale and patterns of related crashes. This study examines the inherent risks of brake-less fixies and evaluates whether the current Road Traffic Act can adequately regulate such vehicles. Focusing on the scope and interpretation of Article 48, it identifies doctrinal issues and proposes a legislative supplement via revision of Article 50(7). The analysis finds that the law lacks explicit definitions and regulatory clauses addressing bicycles without braking systems, undermining effective enforcement and preventive measures. To address emerging forms of mobility, the study recommends explicit statutory provisions and the prompt development of clear regulatory standards as an urgent legislative priority.
