Abstract

The German Federal Constitutional Court, in a series of landmark rulings, has established new fundamental rights and strict control principles to address human rights issues related to online searches in the digital age. Unlike traditional surveillance targeting data in transit, online searches target stored data. Given the nature of IT systems, they pose a high risk of creating personal profiles and infringing upon the core area of private life, even without physical intrusion. In its 2008 online search ruling, the Federal Constitutional Court newly derived the ‘fundamental right to the confidentiality and integrity of information technology systems (IT fundamental right)’ from the general right to personality. This marked a significant turning point in protecting an individual’s informational self-determination and the core area of private life in the digital environment. The 2008 ruling stipulated that actions infringing upon the IT fundamental right, such as online searches, must satisfy the strict principle of proportionality and the principle of normative clarity, declaring relevant legal provisions unconstitutional. This clearly articulated that the stringency and clarity of legal regulations must increase in proportion to technological advancements and the severity of fundamental rights infringements. In the 2013 anti-terrorism data ruling, the Court emphasized the ‘principle of separation’. This ruling pointed out that sharing anti-terrorism data among agencies with differing mandates could constitute a high degree of infringement on fundamental rights. This can be understood as a fundamental rights-based principle of separation, meaning that not only should the mandates and powers of each agency be separated, but also that personal information should not be misused beyond its original collection purpose.
