화이트칼라 계층 범죄자 개인의 성격적 특징에 대한 연구 필요성 높아지고 있다. 특히 화이트칼라 계층에 속한 사람들은 그들이 가진 사회적 지위 만큼 높은 주의력과 실행력을 가지고 있어 이들의 범죄 이면에 내재한 성격적․심리적 요소를 둘러싼 뇌 과학적 특이성은 없을지 가정적 의문을 제기하였다. 특히 화이트칼라 계층 사람들은 항상 합리적 의사결정을 한다는 합리적 선택 이론 역시 공격을 받는 상황에 놓이게 되었다. 본고는 이러한 점을 염두에 두고 화이트칼라 계층 범죄자에게 특별한 신경인지적(neurocognitive) 기능, 그리고 뇌의 구조적․기능적 특징에 대해 국내외 문헌과 사례에 바탕한 이론적 연구를 시도하였다. 신경범죄학의 대표적 사례로서 ‘피니어스 게이지’ 케이스에서 평범한 화이트칼라 계층의 사람도 뇌 손상을 입을 경우 사이코패스와 같은 폭력성을 띨 수 있음을 알게 되었다. 위스콘신카드 분류검사 결과나 손가락 피부전도성 실험 결과에 따르면, 실행기능(executive functioning)이나 주의기능(attentional functioning)에 있어 노상범죄자 대비 화이트칼라 범죄자들의 상대적 우수성이 밝혀졌다. 본고는 화이트칼라 범죄자의 성격적 요인으로서 높은 통제 욕구나 몰락의 두려움을 강하게 표출시키게 하는 높은 수준의 신경인지기능을 화이트칼라 범죄자가 보유하고 있다고 분석하였다. 또 화이트칼라 범죄자들의 심리적 양상을 이루는 근저에 뇌구조, 특히 범죄의사 결정과 관련되어 있다고 알려져 있는 뇌피질 두께(cortical thickness)가 일반 노상범죄자보다 두꺼움을 알 수 있었다. 회백질(gray matter)의 양이 많다는 것 또한 주의기능이나 실행기능과 같은 신경인지기능과 결부되어 화이트칼라 범죄자의 성격적 특징을 결정짓는 신경범죄학적 요인으로 분석되었다.
Abstract
The necessity of research on White-Collar Criminal‘s personality traits has increased. We can suggest that white-collar criminals have high level of attentional and functional ability related to their crimes due to special neuroscientific characteristics. That is why Rational-Choice Theory has been challenged by new sociobiological researches although white-collar criminals was considered to commit crimes based on rational decision. This article introduced theoretical study about wcc’s neurocognitive function and brain characteristics based on domestic and overseas references. According to Wisconsin Card Sorting Test and Skin Conductance, executive and attentional functioning which constitutes WCC's personality traits, is superior to that of street criminals. Cortical thickness of whit-collar criminals turned out to be higher than street criminals, which was known as being relevant to criminal intention or neurocognitive function.
