Abstract
The unprecedented entry of our nation into a super-aged society is accompanied by an explosive increase in the elderly population. The elderly, compared to the general population, are often more vulnerable both physically and mentally, and many face economic hardships due to retirement. The assets accumulated during their youth are often difficult to maintain in the face of rising inflation. Consequently, the elderly are increasingly perceived as socially weak and as victims, exacerbated by abuse, neglect, and societal indifference. However, alongside this demographic shift, there has been a significant rise in crimes committed by the elderly. As mentioned earlier, factors such as mental and physical vulnerabilities, economic challenges, and social neglect contribute to emotional disturbances, leading to impulsive criminal behavior. Additionally, crimes driven by economic necessity, such as those committed for survival, are also on the rise among the elderly. Current laws apply the same legal standards to crimes committed by the elderly as they do to those committed by the general population, with few exceptions, such as diminished mental capacity or insanity. However, the elderly differ from the general population due to age-related cognitive decline, physical and verbal activity limitations, and a slower adaptation to environmental changes. These personal and social characteristics have a complex impact on the elderly. In this context, there is an ongoing debate about whether the elderly, who are increasingly involved in criminal activities, should be punished under the same legal standards as the general population or whether their unique circumstances should be acknowledged with special considerations. For instance, elderly individuals are more physically vulnerable to the effects of alcohol, which may impair their mental state differently than in younger individuals. Thus, applying the same criminal measures may not be a realistic solution. This study examines the overview, current state, and characteristics of crimes committed by the elderly, analyzing their physical and mental traits from a scientific perspective—specifically through the lens of neuroscience, which studies the human brain. The aim is to propose legal and policy solutions that are socially acceptable. The increase in elderly crime is not merely an individual issue but a national and societal problem that future generations will bear economically and socially. Aging is an inevitable part of human life, and society must engage in deeper discussions and considerations to effectively address the growing issue of elderly crime.
