교정단계에서의 자원봉사자의 역할에 관한 연구

형사정책이라는 개념이 정립된 이후 형사사법 분야 그 중에서도 특히 범죄인의 교화개선 분야에 민간인들은 끊임없이 참여해 왔다. 이는 범죄인 관리는 전통적으로 국가가 독점적으로 집행하는 것이라는 사고방식에도 불구하고, 사회공동체의 도움 없이는 실질적인 범죄인의 교화개선은 어렵기 때문이다. 특히 최근 회복적 사법이념의 강조와 더불어 민간인의 교정 분야에의 참여는 더욱 그 중요성이 더해 가고 있는데, 이는 결국 사회로 돌아가야 할 범죄인들을 가능한 그들이 복귀하게 될 사회와 비슷한 환경, 비슷한 사람들이 관리하면 더 효과적이기 때문이다. 우리나라의 경우도 1945년 광복 이후 소수의 종교인과 민간인이 개인적 자격으로 활동한 이후, 2012년 3월 현재 약 20,000명의 민간인이 교정위원 또는 범죄예방위원의 형태로 범죄인 교화활동에 자발적으로 참여하고 있다. 그러나 이러한 양적인 증가에도 불구하고 질적인 면에서는 적지 않은 부작용을 낳고 있는 등 초보적인 단계를 벗어나지 못한 것으로 평가받고 있는데, 이는 미국, 영국 등 서구의 자원봉사활동의 역사가 수세기에 걸쳐 서서히 진행된 반면 우리의 경우 30~40년이라는 짧은 기간 동안에 급작스럽게 창설되고 운영된 결과라 할 것이다. 이에 본 논문에서는 자원봉사 활동의 질적인 면에서의 향상을 위해 자원봉사자의 역할 그리고 체계적인 자원봉사활동을 위한 참고사항 등에 대해 다루어 보고자 한다.
Abstract
Many volunteers have taken part in the rehabilitation of offenders after defining the concept of criminal justice. This is because it is impossible to rehabilitate offenders without the help of community even though it has been recognized that government managed exclusively offenders. Recently, volunteering on the criminal justice is getting more important with the emphasis of restorative justice. This is because it is more effective for members of the community to manage offenders. In Korea, after a small number of religious people and volunteers have taken part in the rehabilitation of offenders since the independence of 1945, about 20,000 volunteers, as of March, 2012, participate in the rehabilitation of offenders in the character as a member of Correctional Volunteer Committee or a member of Crime Prevention Volunteer Committee. However, Korean volunteering system on the rehabilitation of offenders is regarded as being at primary level. This is because Korean volunteering system on the rehabilitation of offenders was established and operated for a short period (30~40 years), as compared with it took two or three centuries to settle down volunteering system in the western countries, such as U.S.A. and U.K. In this article, I examine a desirable role and attitude of volunteers for the qualitative improvement of Korean volunteering system on the rehabilitation of offenders.
