사람은 내가 가진 권력은 안전하고 다른 자가 가진 권력은 위험하다고 생각한다. 제3자가 보기에 모든 권력은 안전하지 못하고 위험하다. 그렇다고 권력을 없애는 것은 불가능하다. 중요한 것은 권력을 통제하여 남용을 방지하는 것이다. 인간의 역사는 절대주의 시대를 마감하고 권력을 분리시켜 자유를 확보하기에 이르렀다. 이것은 영국에서의 의회의 탄생 및 발전, 미국의 혁명전쟁, 프랑스에서의 혁명의 발생을 통하여 이룬 업적이라고 할 수 있다. 오늘을 살아가는 우리들에게 대통령은 무거운 권력문제를 제기하고 있다. 이 시대를 지나면서 느끼는 것은 권력에 대한 프랑스의 역사적 경험과 교훈을 다시 한번 살펴볼 필요가 있다는 것이다. 프랑스는 권력의 소용돌이 속에서 많은 고민을 했고 시행착오를 거친 대표적인 나라였으며 그럼에도 불구하고 민주주의를 계속하여 추진하고 있다. 또한 프랑스는 권력담당 기구와 직위의 변화가 적지 않게 일어나고 있는 나라이다. 이것은 국가 권력의 구조와 기능을 설계하는데 있어서 좋은 참고자료가 될 수 있을 것이다. 프랑스 연구는 우리에게 국가의 권력들 간의 상호관계, 의회의 역할, 권력분립주의, 정부형태를 이해하는 폭넓은 관점을 제공할 수 있다. 대통령이 모든 권력을 압도하는 우리의 현실에서 국가권력 행사의 효율성과 남용 방지에 관한 연구는 중요한 국가적인 과제라고 할 수 있다. 본 논문은 우리들에게 무거운 부담을 야기하고 있는 대통령의 권력문제를 풀 수 있는 우리의 능력을 개발시켜 주기 위한 동기에서 시작했다. 본 논문은 절대주의 시대를 시작으로 하여 프랑스 대혁명의 발생과 그 후에 출현한 여러 헌법들의 내용을 소개하고 있다. 대통령을 이해하기 위하여 총리를 보아야 한다는 것이 본 논문의 추가적인 관점이기도 하다. 대통령을 아무리 들여다본들 숨겨진 모습은 잘 드러나지 않을 것이다. 대통령의 모습을 보려면 옆에 존재하는 총리를 한번은 보아야 할 것이다. 이것을 통한 총리에 대한 새로운 인식은 제왕적 대통령을 방지하는데 큰 도움을 줄 수 있을 것이다. 총리와 대통령은 시소의 한쪽 끝에 앉아 있는 사람들의 관계와 같다. 한쪽이 무거우면 다른 한쪽은 가벼움을 느끼는 것이 바로 시소의 원리이다. 우리에게 필요한 것은 대통령에게 기울어진 시소를 다시 원래의 자리로 복귀시키는 일이다. 이것은 본 연구가 취하고자 하는 궁극적 목적이라고 할 수 있다. 본 논문은 권력의 남용을 방지하고, 인간의 자유와 권리를 적극적으로 보장하기 위하여 어떠한 권력구조가 필요한지에 관한 이해를 돕기 위한 것이다. 이러한 목적을 위하여 역사를 소재로 잡았다.
Abstract
This article has studied the change and development of power structure in France Government including the separation of powers, the executive power, the power of congress, the power of taxation, and the political history of France. There are usually the express provisions on the power structure, separation of powers, the executive power, the power of congress, the power of taxation in the constitutional law. So many legal problems have come in the practice history of the power structure, separation of powers and the forms of government. So the need of study on those subjects in the constitutional law has been acknowledged broadly. Also to improve the understanding and knowledge of those subjects we should study on those subjects. The study on those subjects is very difficult but has very important meanings for the protection of civil liberty and constitutionalism. This article has tried to analyze historically on the power structure, separation of powers, the executive power, the power of congress, the power of taxation and the forms of government. This article has the purpose to give perspectives about those subjects.
