Abstract

Announced by President Obama in his State of the Union Address in January 2015, the Precision Medical Initiative(hereinafter ‘PMI’) quickly emerged as a new policy and next-generation paradigm for health care. The goal of precision medicine is to provide health service providers with new tools, knowledge, and therapies that will enable them to select “the right treatment, at the right time, to the right person.” Immediately after the announcement of the PMI, major countries, including Korea announced a similar and very large-scale initiative for precision medicine. What is precision medicine after all? Why do many developed countries, one after another, competitively initiate rather ambitious large-scale government driven medical research projects? Are these investments worth it? What are the conditions of success for precision medicine, which is highly dependent on the use of emerging technologies including big data, artificial intelligence and biotechnology? Are there any risks involved in implementing precision medicine? If so, when and how should we respond? While the former questions ask for a conceptual and political understanding of precision medicine, the latter beg to examine the legal and regulatory aspects of and challenges posed by this new concept. In particular, laws and regulations serve as an infrastructure for the utilisation of new technologies, demand harmonisation of the interests of many stakeholders, yet, they cannot be easily changed in line with the new policy, a close examination is required prior to the full realisation and implementation of precision medicine. Therefore, this article aims to examine a series of questions raised about the rapid promotion of large-scale research projects for precision medicine both domestically and internationally following the American PMI. It first examines the conceptual and political aspects of precision medicine and next identifies and examines the legal and regulatory issues and challenges surrounding its development and realisation.
