Abstract

This paper examines the relationship between basic income and the duty to work of citizens in the Korean Constitution based on the analysis of the significance and legal nature of duty to work. Basic income refers to the provision of cash on an individual basis, regardless of their income or property, without working conditions. The Korean Constitution specifies the duty to work of citizens, since basic income is characterized by the guaranteeing of income without regard to work, the possibility of conflict with the duty to work can be pointed out. However, it is difficult to conclude that the constitutional duty to work is an obstacle to institutionalizing basic income. First, it is not appropriate to give an active meaning and effect to the duty to work in situations where it is hardly seen as the basic duty of citizens in the constitution and in reality the state is unable to secure enough jobs. As such, there is a need for a limited understanding of the duty to work, so it is hard to say that the duty to work prohibits the introduction of basic income by legislators. Next, there are many different views on the legal nature of the duty to work. However, it is generally agreed that the duty to work is considered as a basis for limiting social security benefits to those who do not have the will to work. Given the systematic aspects of constitutional provisions, it is reasonable to understand that the duty to work is merely an obligation to meet the state's efforts to ensure job. Thus, the provision on duty to work is only a ground for ensuring that benefits directly related to the right to work, such as unemployment benefits, are provided on the premise of work. However, even if the duty to work is regarded as a legal duty that enables the enactment of forced labor by legislators or is understood as just an ethical duty, the provision on duty to work does not necessarily have the effect of forcing legislators to link work with income in establishing a social security system based on the right to a life worthy of human beings. Last, according to the constitution, the extent and conditions of the duty to work are formed only when it is determined by acts with the democracy principle. This reservation is not an order to impose duty to work, but a limited allowance for the legislator to impose duty to work. In this respect, the provision on the duty to work does not prohibit legislators from introducing income security system that is not related to work, such as basic income.
