2021년 전부개정된 지방자치법은 우리나라의 지방정부 기관구성 다양화를 위한 제도적 전기를 마련하였다. 그러나 현재 모든 지방자치단체는 여전히 단체장의 권한이 강화된 강시장형 기관대립형 구조를 유지하고 있으며, 기관구성의 다양화가 현실화되기까지는 상당한 사회적 진통이 예상된다. 이러한 문제의식 하에 본 연구는 우리나라 지방정부 기관구성 형태의 다양화 논의에 정책적 시사점을 제공하는 것을 목적으로 한다. 구체적으로는 시장-의회형과 의회-매니저형을 중심으로 관련 이론 및 실증연구를 검토하고 해외 지방정부의 다양한 기관구성 사례를 분석한다. 특히, 전통적인 정부형태 분류(시장-의회형 및 의회-매니저형)에서 한 걸음 더 나아가, 다양한 세부 기준을 추가한 확장된 분류체계를 검토함으로써 우리나라 기관구성 전환 논의의 방향성을 모색하고자 한다. 해외 선행연구를 종합해 보면, 지방정부 기관구성의 변화는 단순한 행정조직 개편을 넘어 정부 핵심구성원의 동기구조 및 정부성과에 상당한 영향을 미치는 것으로 보고되고 있다. 또한 최근의 실증연구들은 지방정부 기관구성의 외형적 구조에만 주목하는 것을 넘어, 단체장, 지방의회, 전문행정인(CAO) 간의 권력구조, 권한배분, 역할 설정 등에 내재된 역학관계와 견제⋅ 균형의 메커니즘을 면밀히 고려해야 함을 시사한다. 이에 본 연구는 해외의 다양한 경험적 사례를 기반으로 정부와 학계가 지방정부 기관구성 전환의 현실화를 위한 전략적이고 체계적인 담론을 전개해 나가야 함을 제안한다.
Abstract
South Korea’s recent revision of the Local Autonomy Act has created new opportunities for more flexible and diverse local government structures. Despite this legal change, all local governments still operate under a strong mayor-council system, with limited variation across jurisdictions. Achieving genuine institutional diversity is likely to involve significant social and policy challenges. This study explores how South Korea might diversify the institutional design of its local governments. It focuses on two main models; the mayor-council and the council-manager forms through a review of key theories, empirical studies, and international examples. The study also examines expanded classification frameworks that move beyond traditional forms, offering new directions for institutional reform. Previous research on forms of government shows that structural changes in local governance affect not only administrative operations but also the motivations and behavior of key officials, as well as overall government performance. More recent studies emphasize the importance of examining the relationships and power dynamics among mayors, local councils, and chief administrative officers (CAOs), rather than focusing solely on formal structures. The findings suggest that both local governments and scholars should take these dynamics into account in shaping the discourse on structural reform.
