Abstract
Regulatory reform concerns an improvement to the quality of regulation. From this perspective, regulatory reform includes both deregulation and strengthening of existing regulations. Additionally, the integrity of regulation is based on the transparency of the regulatory process from legislation to application. Deregulation is not an unconditional abolishment of regulation; instead, it just reduces the regulatory burden. Deregulation is aimed to restore the right of freedom - the most important fundamental right guaranteed by the constitution. The nation has a wide range of authority to reduce regulation within the law. Social regulation is easily approached to be legislated with social consultation. In contrast, economic regulation sometimes causes conflict of interests between large businesses and small and medium-sized enterprises (SMEs), as well as between private enterprise and public enterprise. In these cases, deregulation is based on a strict observance of the constitution and the principle of proportionality. There are several policies for regulatory reform. First, when legislators consider reducing the regulatory burden, the government calculates the compliance costs of following the regulatory norms. Moreover, government is compelled to keep down the regulatory burden volume, making it necessary to assess the regulatory burden, measuring it objectively thinking in terms of the regulated to feel the regulatory reform. Second, negative regulation methods and sunset clauses are introduced as a regulatory reform prior to the pertinent new legislation being passed by the government. Under negative regulation systems, people can act as desired unless prohibited by the law, which more often than not accelerates individual creativity, and promotes industry innovation. Negative regulation systems also ruled the Korea-US free trade agreement. Especially cases of “ratchet clauses,” which are legislated as one negative regulation system; meaning current levels of privatization would be locked in. Government needs to be careful to bring in ratchet clauses, and restricting authority of making new rules. Third, government could try to change the permission clauses for reporting. Finally, reporting without need of authorities’ acceptance is a useful policy for deregulation. Reporting without acceptance becomes effective once the report arrives at the receiving government. Under the current system, government prefers the need of reporting before acceptance, in order not to lose regulatory authority. Reporting with need of acceptance is not reducing the regulatory burden because people still ask for permission. Deregulation is not always the best regulatory reform. There are cases that regulation has to be maintained to not undermine public safety or welfare. Government needs to know regulatory reform means not only deregulation, but also introducing new regulation.
