백신 정책에 관한 헌법적‧윤리적 고찰: 면역여권부터 방역패스까지

초록

코로나 팬더믹 이후 백신과 코로나 치료제가 코로나를 극복하기 위한 과학적 해결책으로 개발이 되었다. 코로나19 백신 예방 접종을 독려하고 감염병 확산을 차단하기 위한 방편으로서, 각종 대중 이용시설을 출입과 집회를 위하여 백신 접종을 증명해야 하는 이른바 ‘방역 패스’도 시행된 바 있다. 이 방역 패스는 백신 접종률을 높이는데도 큰 역할를 할 수 있으므로 전세계적으로 방역 정책의 일환으로 시행된 바 있다. 방역 패스는 감염병 확산을 방지하는 문턱으로서 백신 접종을 촉진하여 국민 건강을 유지하는 역할을 할 수 있다. 그러나 백신 효과의 불확실성과 개개인의 건강에 미치는 위험의 잠재성 뿐 아니라 접종자와 미접종자를 불합리하게 차별하는 기본권적 한계를 안고 있다. 우리 헌법상으로 보건에 관한 국가의 보호가 기본권으로 보장되어 있으나, 백신 패스가 적용되면 백신을 접종하지 않은 사람은 각종 시설의 출입 제한을 당하게 되기 때문에, 백신 접종자와의 차별의 문제가 발생하게 된다. 여기서 발생하는 기본적인 인권의 문제로는 평등의 원리 즉 차별 금지의 인권이다. 그래서 방역패스 시행에 있어서 기본권 보장이 철저히 지켜져야 하기도 하지만, 백신 접종에도 안전성을 담보할 수 있는 국가의 책임이 강조되어야 한다. 본 연구에서는 방역 패스의 원조인 면역여권의 등장하게 된 배경부터 윤리적 쟁점, 그리고 방역 패스를 둘러싼 기본권적 쟁점과 기본권 제한의 정당성 요건 및 기본권 보호를 위한 국가의 책임을 살펴보았다. 방역 패스 방식이 기본권과 관련되어 있다는 점을 유념하여, 국회에서 정당한 합의를 거쳐서 입법적 근거를 마련함으로써 국민적 정당성을 확보하는 것이 방역 패스라는 방역 정책 시행의 전제가 되어야 한다.

Abstract

After the COVID-19 pandemic, vaccines and anti-covid drugs have been developed as scientific solutions to overcome COVID-19. As a measure to encourage vaccination against COVID-19 and prevent the spread of infectious disease, the so-called ‘vaccine pass’, which is used as the proof of vaccination to enter and access various public facilities, has also been implemented. Vaccine passes has been implemented worldwide as part of preventive measures against COVID-19 because it could play a big role in increasing the vaccination rate. A vaccine pass can serve as a threshold to prevent the spread of infectious disease, and can play a role in maintaining public health by promoting vaccination. However, it has limitations in constitutional basic rights that unreasonably discriminate between vaccinated and non-vaccinated as well as uncertainty of vaccine effectiveness and potential risk to individual health. Therefore, while the basic rights must be thoroughly guaranteed in the implementation of the vaccine pass, the responsibility of the state to ensure safety for vaccination must be emphasized. Controversy is still ongoing concerning the protection of people who were vaccinated and then injured or died as a result of a serious adverse reaction due to the enforcement of the vaccine pass, but no clear causal relationship between vaccination and the outcome of the injury or death was recognized. if the vaccine pass is applied, people who are not vaccinated will be restricted from entering various facilities, so there is a problem of discrimination with those who have been vaccinated. The basic human rights problem related to the vaccine pass is the principle of equality, that is, the human rights of non-discrimination. In this study, it is reviewed that legitimacy requirements for protecting the constitutional basic rights are needed by examining the background of the emergence of the immunity passport, the ethical issues, and constitutional basic rights issues surrounding the vaccine pass and the state's responsibility to protect basic rights. It is suggested for keeping in mind that the vaccine pass method may limit fundamental rights, that securing national legitimacy by preparing a legislative basis through a legitimate agreement in the National Assembly should be a prerequisite for policy implementation.
