면역 여권, 코로나 시대 양날의 검 -공법적 검토와 윤리적 함의-

면역 여권은 전 세계적인 감염병 위기 상황인 팬더믹에서 백신 접종을 받았다는 증명을 통해서 국가 간의 안전하고 용이한 이동을 촉진시키기 위해 논의되고 있는 증명서이다. COVID-19에 대해 면역력이 있거나 향후 감염될 가능성이 없다는 사실을 입증하는 다양한 양식의 증명서를 칭한다. 감염병 확산 방지와 예방을 위한 봉쇄, 격리 및 이동 제한 조치로 인하여 발이 묶인 인류에게, 코로나 시대의 면역 여권은 일상의 삶으로 복귀하고 경제무역 활동에 속도를 내게 하는데 도움을 주기 위한 방편으로 활용이 될 수 있다. 현재 독일과 프랑스 등 EU 회원국들은 높은 백신 접근성과 접종률을 기반으로, 백신 접종 여부를 증명해주고 격리 의무를 면제하는 혜택을 주는 면역 여권을 도입하여 시행하고 있다. 한국의 경우도 질병관리청이 신종 코로나바이러스 감염증에 대응하는 백신 전자 예방접종 증명서에 대해 검토하고 있다고 발표하였기 때문에, 면역 여권 도입에 관한 윤리적, 사회적, 법적 논의가 필요한 시점이다. 국민의 안전을 담보하면서 질병으로부터 안전한 여행의 자유와 이동을 보장하기 위해 면역 여권이 최선의 방책인지, 코로나 사태 이후 면역 여권에 관한 윤리적, 사회적, 법적 논의를 진행해온 유럽의 논쟁과 현황을 살펴보고, 우리나라에도 도입 가능성이 있는 면역 여권이 내포하고 있는 윤리적, 공법적 함의를 제시하기로 한다.
Abstract
Immunity passport is a certificate being discussed and introduced to facilitate safe and free movement between countries through proof that they have been vaccinated in the COVID-19 pandemic, global infectious disease crisis. It is referred to various forms of certificates that demonstrate that someone is immune to COVID-19 or is unlikely to be infected in the future. For humans stranded by lockdown, quarantine and movement restrictions to prevent infectious diseases, the immunity passport can be used as a way to help them return to their daily lives and speed up economic and trade activities. Currently, EU membership states are establishing infrastructure such as system maintenance and technical standardization and preparation for national certification to introduce Digital Green Certificate(DGC) that prove vaccination and exempt isolation obligations based on high vaccination rates. To ensure safe travel and mobility while ensuring the health and safety of the people, through this paper the controversy and present state of introduction of Europe concerning immunity passport are examined since the COVID-19 pandemic crisis, and from that review, ethical and public legal implications of immunity passport are suggested for future reference in Korea as the Korea Disease Control and Prevention Agency announced that it was reviewing a electronic vaccination certificate against new Corona Virus infections.
