표준의 포괄적 규범성과 공동 규제성:유럽연합과 독일의 사례를 중심으로

표준은 법령 및 사회 규범과 중첩되는 포괄적 규범이며, 공공 기관에 의한 강제적 규제와 민간 기구에 의한 자율적 규제의 공동 규제성을 띤다. 포괄적 규범으로서 표준은 인간과 인간 관계 및 인간과 사물의 관계와 사물의 성질까지 규정하며, 공동 규제에 입각한협치(governance)로 실현된다. 유럽연합과 독일에서 표준의 이러한 위상은 자발적 준수의대상이 되지만 공공성이 강한 영역에서는 법령에 의해 그에 준하는 지위를 획득하거나 강제적 준수의 대상이 되는 것으로 나타났다. 이 사례들이 공통적으로 시사하는 것은 포괄적 규범성을 보장하기 위해 민간 기구에 의한 자율적 규제와 공공 기구에 의한 강제적 규제를 조화시켰다는 점이다. 최근 민간 이양을 추진하고 있는 우리나라 표준화 정책은 이러한 포괄적 규범성과 공동 규제성에 입각해 표준화 기구의 공적 권위를 유지하는 범위에서 조정 기능을 활성화하는 방향으로 나아갈 필요가 있다.
Abstract
Standards are comprehensive norms which overlap with and include directives and social norms and standardization is understood as a co-regulation, not only mandatory regulation by public agencies but also voluntary regulation by private organizations. As comprehensive norms, standards regulate human and the relationship between peoples as well as nature of things and the relationship between people and things. And standardization is realized as governance through co-regulation. In the European Union and Germany, standards are not simply the object of voluntary compliance but also the object of mandatory compliance as directives or quasi-statutory one acquired by directives. These cases suggest in common that compulsory regulation by public agencies and autonomous one by private organizations are harmonized in order to ensure the comprehensive normativity of standards. The recent South Korean standardization policy which promotes privatization needs to be carried out in the direction to activate the coordination function of standardization body in the condition of maintenance of its public authority based on the comprehensive normativity and co-regulation characteristics of standards.
