대통령 후보 TV토론의 법적·제도적 쟁점 및 개선방안 연구

TV토론은 기존의 유세선거의 단점인 고비용 선거구조의 개선뿐만 아니라, 후보자들을 비교 분석할 수 있게 해주며, 유권자들이 선거의제를 설정하는 데 도움을 주고, 후보자들의 품성과 자질을 평가할 수 있는 기회를 제공하는 유용한 선거제도이다. 우리나라에서 공직선거 후보를 대상으로 하는 TV토론은 1995년 서울시장선거에 처음 시작되었으나 TV토론이 선거제도화된 것은 1997년 선거법 개정으로 시작된 1997년 대통령선거에서의 후보초청토론이다. 2004년 선거법 개정으로 선거방송토론위원회가 상설화되고 공직후보 TV토론은 국회의원과 기초자치단체장 선거로까지 확대 적용되고 있다. 본 연구는 2004년 선거방송토론위원회가 상설기구화되면서 처음 맞는 2007년 대통령선거를 앞두고 대통령 후보 TV토론 제도와 관련한 법ㆍ제도적 쟁점과 운영상의 문제점을 점검하고 개선방안을 연구하고 있다. 먼저, 법ㆍ제도적 쟁점으로 공직후보 TV토론이 TV매체를 통해 선거제도의 하나로 이루어진다는 점에서 형평성과 공정성과 관련한 관련법 조항들에서 나타나는 쟁점 및 문제점을 검토하고 개선방안을 제시하였으며, TV토론 주관자인 선거방송토론위원회 관련 문제점과 개선방안을 제시하였다. 다음으로 TV토론 초청대상 기준과 개최시기 및 횟수에 관한 쟁점 및 개선방안을 제시하였다. 마지막으로 공직후보 TV토론의 운영상 문제점들을 검토하기 위해 토론형식과 의제, 토론진행방식, 사회자 및 패널리스트와 관련한 쟁점과 개선방안을 제시하고 있다.
Abstract
Our country’s TV debate first started from the regional election on 1995. After that, TV debate settled down, becoming the leading method of election campaign and impressively improved our election culture. However, the problems of TV debate have constantly occurred. Especially after the 15th presidential election, many studies pointed out the problems of TV debate in presidential elections and proposed several improvements. TV debate prevents dishonest elections, reduces costs of election, and strengthens the fragmentary election related reports. The candidates directly suggest their policies through TV debates, have a chance to show, their images distinctively. The voters can compare each candidates through TV debates and also can gain the information needed in choosing their supporting candidate. Presidential candidates tries to use the debates as one of their campaign strategies. Analysis of the debates reveals that the televised broadcasting is centered on the election campaign as an effective mean for persuading the mass of people, since politics is the social activity based on the power coming from views of the majority. This study should propose TV debate of legal and systematic issue and improvement alternative in the 2007 Televised Presidential Debates. This study researches the television program format in the Korean presidential candidate debates which focused on policy. There are a lot of components of debates: debate sponsorship, candidates in debates, moderator, selection of panelists and their role, themes, the number of debates, their dates, locations, time, other televising related items, and procedures in detail etc.
