‘절대적 집회금지장소’ 규정에 대한 일반시민들의 인식 - 집회시위 경험의 영향을 중심으로 -

1962년 집시법 제정 이래 국회의사당, 법원, 헌법재판소 등의 경계 지점으로부터 100 미터 이내 장소에서의 집회시위는 해당 기관의 기능수행 보장을 위해 금지되어 왔다. 최근 헌법재판소에서 이러한 절대적 집회금지장소 규정에 대해 연이어 헌법불합치결정을 내린 가운데, 본 연구는 절대적 집회금지장소 규정의 필요성에 대한 일반시민들의 인식 정도를 측정하고 이에 영향을 미치는 요인들은 무엇인지 살펴보았다. 완화된 순서형 로짓 회귀모형을 토대로 분석한 결과, 집회시위와 관련된 개인적 차원의 경험, 그 중에서도 집회시위로 인한 피해, 집회시위에서의 경찰 대응에 관한 경험은 장소적 금지 규정의 필요성에 대한 인식에 통계적으로 유의한 영향을 미치는 것으로 나타났다.
Abstract
Since the enactment of the Assembly and Demonstration Act in 1962, an assembly in places where within a 100-meter radius from the boundary of the important buildings or residence of special interest ― such as the National Assembly building, all level of courts, and the Constitutional Court ― has been prohibited. While the Constitutional Court has decided the relevant provision as unconstitutional, the study seeks to measure the perception of citizens on the necessity of the provision and to find factors on the civil perception. According to the analysis result based on the partial proportional odds model, experiences regarding assembly at the individual-level, particularly damage due to an assembly, and police reaction during an assembly process, were found to be statistically significant for the perception on the necessity of the provision.
