집회ㆍ시위는 헌법이 보장하는 기본권으로 그 자유는 최대한 보장되어야 하지만 집회ㆍ시위는 단순히 시위대와 진압 경찰력만의 문제가 아니라 일반시민들도 관련된 사회적 문제이다. 이 연구에서는 합법적인 집회는 반드시 보장되어야 하지만 다른 사람들의 이익과 국민 전체의 공익을 침해하지 않는 범위 내에서만 보장된다는 내재적인 한계를 가진다는 관점을 가지고 한국의 집회ㆍ시위의 역사적 변천과정과 1997년부터 2006년까지의 집회․시위의 실태분석을 통하여 바람직한 집회․시위문화 정착방안을 모색 하였다. 바람직한 집회․시위문화의 정착방안으로는 첫째, 집회ㆍ시위의 권리에 대한 인식의 전환이 필요하다. 즉, 집회ㆍ시위의 권리행사에 대한 의식전환과 불법 집회․시위로 인한 피해의식 제고, 그리고 합리적집회ㆍ시위문화 정착을 위한 지역단위 커뮤니티가 활성화되어야 한다. 둘째, 경찰 법집행의 일관성이 유지되어야한다. 즉, 집회ㆍ시위관련매뉴얼을 개발하고, 불법 집회․시위에 대해서는 엄정하게 대처하며, 사후평가와 환류기능을 강화할 필요가 있다. 셋째, 지역단위 갈등해결 조직을 형성하고 집단갈등을 원활히 해결할 수 있는 능력을 갖춘 갈등관리 전문가를 양성하는 등 사전적 보완이 필요하다. 마지막으로 여론형성에 큰 역할을 하는 언론의 중립적이고 공정한보도문화가 정착되어야 할 것이다.
Abstract
The Right of Assembly and Demonstration is Basic right on the Constitution, and its freedom must be guaranteed the maximum. but It is not the simple problem which police and demonstration, but the social problem which relates with the citizens. This Study From like this viewpoint, Which is the legitimate Assembly must be guaranteed, but the right is guaranteed when it does not infringe the common good‘s right and the other citizen's right. It tries to observe a history change process Assembly and Demonstration in korea and From 1997 until 2006 the actual condition analysis of Assembly and Demonstration. And It presented a desirable Culture of Assembly and Demonstration fixations plan from this research. To Settle down the Culture of Assembly and Demonstration, Firstly, It is the necessary to the conversion of the recognition against The Right of Assembly and Demonstration. Namely, the conversion of the recognition against The Right of Assembly and Demonstration, Raising the damage recognition against illegal Assembly and Demonstration, And The community above the regional group must be activated. Secondly, The police law enforcement must be a consistency. Namely, It is necessary to develop the Assembly and Demonstration manual, must confront strongly against the illegal Assembly and Demonstration, And to strength the evaluation and feedback. Thirdly, It is necessary to educate the specialist for conflict management, who equips the ability it will be able to solve a group conflict. Lastly, The mass-media attitude of negatively reporting policing should be settle down to that of being fair and justice.
