한국형 집회·시위 문화 정착을 위한 과제: 시민과 경찰 간의 분화적 인식을 중심으로

Abstract

This study verifies empirically what perception gap exists between police officers and protesters, besides, the aim of this study is that suggests a policy plan to set up healthy assembly and demonstration culture, which is possible to cut conflict and collision by the perception difference. The four categories were selected in this study to check the gap in perception between people and police officers about assembly and demonstration; knowledges of law for assembly and demonstration, general thinking of assembly and demonstration, opinion on police officers response to assembly and demonstration, and view on behavior of protesters and demonstrators. The questionnaire survey was conducted targeting general citizens and police officers who are living in Gumi and Ulsan city, then utilized 610 of collected data. This research data in this study drawn upon basic statistics, t-test, and ANOVA to figure out perception difference in assembly and demonstration between citizens and police officers. The results of survey showing perception gap in assembly and demonstration between the citizens and police officers are the meaningful difference in perception(p<.000). This study which is based on the results of analysis suggested that policy plans to solve difference in perception between the general citizen and police officers for assembly and demonstration as follows. Firstly, it presents improvements on the Act on the assembly and demonstration to reinforce the regulation on assembly and demonstration in the evening, amend the rules for minimizing conflict by plain-clothes police officers, restrict sternly the police officers evidence collection, prohibit wearing disguises and/or mask, and draw up a practical bill on noise control. Secondly, to make better awareness about assembly and demonstration, it proposed to set up a wholesome protest culture, and change the cognition as a process of social integration. Thirdly, it suggested development and application of police officer's response guide, as well as establishment a review committee on police action on assembly and demonstration in order to reform responsive measures by police officers. Lastly, to improve behaviour of manifestant, it proposed to tighten the control system for participants of organizer, legitimate responsibility for unlawful and violent assembly and demonstration.
