개정 「집회 및 시위에 관한 법률」 제11조에 대한 비판적 검토

제20대 국회는 마지막 본회의에서 집회·시위의 장소에 관한 헌법재판소의 헌법불합치 결정을 반영하여 「집회 및 시위에 관한 법률」 제11조를 개정하였다. 개정 법률안은 ‘원칙적 금지, 예외적 보장’이라는 헌법재판소 결정의 취지를 반영하여 국회의사당, 국무총리 공관, 각급 법원 및 헌법재판소를 집회·시위 금지장소에 포함하되, 예외적으로 집회·시위를 할 수 있는 경우를 각각 제시하였다. 본 연구는 제20대 국회에서 발의되었던 집회·시위 장소에 관한 법률안을 분석하였다. 연구 결과, ‘집회 장소 선택권을 적극적으로 보장해야 한다’는 방안부터 ‘헌법재판소 결정 취지에 따르면 충분하다’는 방안까지 다양한 의견이 제시되었다. 그러나, 국회는 헌법재판소의 결정 취지에 천착하여 집회 금지 대상기관의 범위를 축소·폐지에 관한 논의를 일축하고, 집회 금지 대상기관을 유지하는 개정안을 통과시켰다. 이에 따라, 집회 장소 선택권의 관점에서 대상기관이 적절하게 설정되었는지, 규율 방식을 ‘원칙적 금지, 예외적 허용’ 또는 ‘원칙적 허용, 예외적 제한’ 가운데 어떠한 태도를 보일 것인지, 개정 법률안에서 제시한 예외 사유의 성격은 무엇인지 등에 관한 논의의 여지를 남겼다. 집회 장소 선택권은 헌법상 기본권인 집회의 자유를 보장하는지를 판단하는 결정적 요소이다. 따라서, 집회·시위 금지 대상기관은 최대한 축소하려는 노력이 필요하며, 집회·시위의 장소적 제한을 규율하는 방식도 ‘원칙적 보장, 예외적 제한’의 관점에서 접근해야 하고, 개정 집시법 제11조의 예외 사유도 예시 규정으로 보아 ‘대상기관의 기능과 안녕을 침해할 우려가 있는지’를 기준으로 금지 여부를 결정하여 평화적 집회의 자유를 실질적으로 보장할 수 있어야 한다.
Abstract
At the last plenary session, the 20th National Assembly revised Article 11 of the Law of Assembly & Demonstraion, reflecting the Constitutional Court's decision to disagree with the Constitution on the place of assembly and demonstration. The revised bill reflected the purpose of the Constitutional Court's decision of 'prohibition in principle, exceptional guarantee'. Specifically, the National Assembly building, the Prime Minister's official residence, courts at various levels, and the Constitutional Court were included in the places prohibited from assembly and demonstration, and exceptional cases were presented. This study analyzed the bill on the venue of assembly and demonstration proposed by the 20th National Assembly. As a result of the study, various opinions were suggested, ranging from "the right to actively guarantee the choice of venue for assembly" to "it is sufficient according to the purpose of the Constitutional Court's decision." However, the National Assembly dismissed the discussion on the reduction and abolition of the scope of institutions subject to assembly prohibition and passed an amendment to maintain institutions subject to assembly prohibition. Accordingly, there is still room for discussion; whether the target institution is properly established from the perspective of the right to choose the venue of the assembly, what will be the attitude between "Prohibition in Principle, exceptional permission" or "Guarantees in principle, exceptional restraints", and the nature of the reasons for exception presented in the revised bill. The right to choose a meeting place is a decisive factor in determining whether the law guarantees freedom of assembly, which is a fundamental right under the constitution. Therefore, the National Assembly should try to reduce the number of institutions subject to prohibition of assembly and demonstration as much as possible. The method of regulating the place restrictions of assembly and demonstration should also be approached from the perspective of 'principle guarantees, exceptional prohibitions'. The reasons for the exception to Article 11 of the revised Law of Assembly & Demonstraion should also be determined based on "whether there is a risk of infringing on the function and well-being of the target institution" as an example regulation. Through this, it should be possible to substantially guarantee freedom of peaceful assembly.
