Abstract

In the jurisprudence of common law states on the legality of coup d'état, cases are divided into two categories. The first category covers cases where the judges generally upheld the regime's validity with the doctrine of revolutionary legality of Hans Kelsen. The second category includes cases where the judges are challenging the legality of usurper regime on the ground that the coup fails to obtain permanent recognition of people. The latter, so-called doctrine of popular acceptance, is dominant in recent cases. In addition, the courts sometimes adopt the principle of necessity for the purpose of legalizing acts taken by usurper regime after the coup. The doctrine of popular acceptance is best expressed in the Mitchell case of Grenada, where the court summarized elements for the legality of the coup into four factors. These are a) the coup was successful, b) its rule was effective, c) popular acceptance, d) the regime was not oppressive and undemocratic.
