서구에서 18세기 말부터 나타나기 시작한 지방자치권에 대한 이론은 시대와 장소에 따라, 매우 더디기는 해도, 발전해 왔다. 프랑스 혁명 당시의 투레의 지방권이나 19세기 말 독일의 기르케의 자치권 이론은 근래 일본의 신고유권설로 변모하였다. 한편 쿨리 독트린에 근거한 19세기 말 미국의 임페리오형홈룰은 20세기 중반에는 입법형 홈룰로 발전하여 주-지방 정부 사이에 입법에 대한 권한공유의 길을열었다. 하지만 이들 자치권론을 오늘날 다원주의 시대에 적합한 지방자치권으로 보기에는 한계가 있다. 따라서 이 논문은 기존 지방자치 이론의 발전을 재조명한 후 19세기 중반 네덜란드의 토르베커의공동-거버넌스 체제에서 볼 수 있는 중앙정부와 지방정부가 통치권을 공유하는 구조를 오늘날 거버넌스 시대에 보다 적합한 모형이라 주장한다. 그리고 이 체제의 논리적 근거가 될 수 있는 국가와 개인 사이의 중간에 있는 공동체에 대한 이론의 중요성에 대해 언급한다.
Abstract
The theories of local autonomy right have been developed since it appeared national constitution in the late eighteenth-century. Thouret’s local right(pouvoir municipal) at constitutional convention during the French Revolution and Gierke’s group right have revived as neo-indigenous right of local autonomy in Japan. In addition, Home Rule which is inspired by Cooley’s Doctrine developed as Legislative Model that state and local government are sharing legislative power. However these theories fall short as a model for local autonomy right in the era of co-governance. Thus this paper reviews the theoretical developments and then proposes a power-sharing model which can be derived from Thorbecke’s constitutional system in the middle of nineteenth-century Netherlands. After that this paper insists on the need for exploring theories of the group which stands between the state and the people.
