자치분권 원리로서 ‘주민주권’의 이론적 토대 정립을 위한 시론(試論)

초록

본 연구의 목적은 근대 주권론과 국민주권론의 역사적･학술적 검토를 통해 자치분권의 주요원리로 등장하고 있는 주민주권의 규범적 토대를 마련하는 것이다. 이러한 목적을 위해 본 연구는첫째, 지방자치의 원리로서 지방민주주의의 개념 정립의 필요성과 지방민주주의 원리의 보완을 위한주민주권 개념과의 관계를 논의한다. 둘째, 이론적･제도적 관점에서 근대 주권 개념의 진화과정과미국과 프랑스 혁명에 뿌리를 둔 인민주권 원리의 성립과정을 검토한다. 동시에 추상적인 인민주권원리가 현존하는 문화공동체인 민족과의 결합을 통해 근대 민족주의가 부각되고 정치공동체모형으로서 민족국가가 착근하게 되는 원리와 과정을 분석한다. 셋째, 앞의 논의를 중심으로 사회적구성으로서의 근대 주권론의 성격을 밝히고, 현대 사회의 변화에 따른 민족국가와 국민주권론이직면한 다양한 도전과 위기를 진단한다. 마지막으로 현대 사회의 구조적･이념적 도전에 대응해국민주권을 실현하는 혁신전략의 관점에서 주민주권이 가지는 의미를 제시한다.

Abstract

This study aims at establishing a normative theoretical basis of resident sovereignty currently drawing attention as a local autonomy principle. To achieve it, this article carries out a historical and analytical review of popular as well as modern sovereignty principles. To provide a background discussion, more specifically, this article starts with the articulation of local democracy as a local autonomy principle and its complementary relationship with resident sovereignty. Secondly, it reviews the evolutionary process of modern sovereignty principle. It also traces the history of popular sovereignty doctrine originated in American and French Revolutions. Furthermore, this study explores the historical process of combining ‘people’ as an abstract political community with ‘nation’ as a cultural community. This process contributes to the settlement of nation state as a dominant modern political community model. Thirdly, it discusses the social constructed nature of sovereignty and diagnoses the challenges for nation state and popular sovereignty under current rapid social change. Finally, it provides the implication of resident sovereignty as an innovative strategy to achieve popular sovereignty which has recently undergone severe structural and ideological challenges.
