지방자치권은 ‘국가가 지방에 준 권한’에 한정된다는 논리의 전래권설, 월권금지원칙, 그리고 딜런 룰이 통설이다. 이런 논리에 대응하여 나타난 것이 ‘지방의 독자적인 권리를 인정하는’ 홈룰이다. 당초 임페리오형을 거쳐 입법형으로 발전한 홈룰은 미국의 대부분의 주에서 헌법상 채택되고 있다. 이 논문은 홈룰의 발전과정과 모형의 법적･정치적 의미를 정리한 후 홈룰이 시사하는 바에 따라 우리 지방자치권의 확대방안을 모색한다. 우리 지방자치단체는 ‘법령의 범위 안에서’만 자치에 관한 규정을 제정할 수 있어 지방의 이니셔티브가 극도로 제한될 뿐만 아니라 지방의 면책 범위도 매우 좁다. 이런 한계를 극복하는 방법으로서 이 논문은 국가주의 논리에 대한 지방의 도전, 입법형 방식의 권한배분, 행정적 통제에서 입법적･사법적 통제로의 전환, 주민의 자치능력에 대한 신뢰 제고, 그리고 지방의 정책적 실험 장려를 제시한다.
Abstract
Most countries in the world recognize that local governments have only the powers which are granted by central government following such rules as the ‘state right’ of continental Europe, Ultra Vires in United Kingdom, and Dillon’s Rule in America. However, several states in America has developed constitutional home rule in response to Dillon’s rule to extend local autonomy. Home rule model which started from the imperio model in the last quarter of 19 century evolved to legislative model in the middle of 20 century. In the course, most American states have adopted a form of home rule for their political sub-divisions. This paper summarizes the evolution of home rule and explains the legislative home rule model which allows both extensive local initiative as well as broad state preemption. And then this paper proposes the legislative model as a benchmark for Korean Local Autonomy where local initiatives are severely limited. To adopt the model as Korean’s this paper propose the followings: challenges to state paternalism, devolution for local initiative, legislative control rather than administrative control, recognizing local authority abilities, and allowing for more local policy experiments.
