Abstract

Around 7.5 million overseas Koreans are living in 193 different countries around the world. Overseas Koreans in each country not only have a relationship with their home country and their fellow Koreans depending on social, cultural, economic, and political conditions and environment, but also with the country of residence or the people of their home country of residence. In these various relationships, the legal status of overseas Koreans is a not only a key element in maintaining order between various parties, but it is also essential for restoring and maintaining reconciliation and peace in the event of a dispute. Therefore, guaranteed legal stability by national standards and values is a very important value of life for overseas Koreans. Various complex factors, such as individualism, groupism, and culturalism, is a catalyst for conflict within the life of overseas Koreans. Consideration and understanding of their characteristics and structure is a necessary condition in resolving and coordinating conflicts within the community. In particular, contrasting information between social media and the press, not to mention geographical differences between said information, only accelerates strife: one that is accompanied by an increase in time, cost, and pain in resolving disagreements. In addition, if arguments escalate into legal disputes that is overseen by the jurisdiction of a legal court, the conflict is only needlessly prolonged and additional costs will be incurred. Examining legal stability within laws related to overseas Koreans is a very important factor in freedom and stability. In addition, the establishment of a mediation system in charge of the press and social media in countries where overseas Koreans reside, will preside over information and reveal the truth regarding overseas Koreans and their respective communities. Furthermore, if an Alternative Dispute Resolution (ADR) system is incorporated and well-established, previous conflicts between overseas Koreans can be used as a framework for reconciliation, prosperity, and prevention of future disputes.
