사회정책결정과정의 절차적 합리성 분석:비정규직보호법 사례를 중심으로

공공정책의 결정에 있어서 합리성은 매우 중요한 가치기준이다. 실질적 합리성은 정책결정에 있어서 기본적으로 추구되는 가치이지만 분석과정상 현실적 한계가 있어 절차적 합리성이 중시되고 있으며 특히 참여정부에서는 그 가치가 높이 평가된바 있다. 그래서 이 연구에서는 중요한 사회정책의 하나인 비정규직보호법의 제정과정에서 절차적 합리성이 어느 정도 존중되었는지, 그리고 절차적 합리성은 정책내용과 그 이후 정책집행과정에 어떤 영향을 미쳤는지 분석하여 보았다. 그 결과 입법절차의 공개성, 공평성, 다양성 등 절차적 합리성은 상당히 높았고, 정책내용도 합목적성, 사회적 형평성이 매우 높아 정책내용의 적합도가 바람직한 수준에 이른 것으로 평가되었으며, 이는 정책집행에 있어서 순응성과 효율성이 높아지는 요인이 된 것으로 평가 되고 있다. 한국의 사회정책과정에서 절차적 합리성은 정책내용과 정책집행의 적합성을 제고하는데 상당한 기여를 한 것으로 나타나고 있다는 것이다.
Abstract
The Rationality is very Important Factor in The Public Policy Making. The Substantial Rationality is Basic Value in The Policy Making, But There are Many Errors in The Analysis of Substantial Rationality, Therefore Procedural Rationality 1s Considered More Important Factor as Policy Analysis Factors. This Study was Focused on The Procedural Rationality Through The Making Process of The Protection Law for Non-Regular Labors and Its Political Impacts. We could Find That The Lavel of The Procedural Rationality, As It Were The Level of Opening, Fairness, Diversity Was Very High. It is Very Interesting Point That The Procedural Rationality Was Very Important Factors For Adoptability of The Policy Contentsand The Policy Executives in The Social Policy Process in Korea.
