유전공학관련 분쟁 발생시 손해배상책임 - GMF(Genetically Modified Food)와 제조물책임을 중심으로 -

초록

Abstract

Lately, there have been many multidisciplinary studies focusing on the Living Modified Organisms(LMO), whether domestically or overseas, but there are very few studies investigating into potential LMO-related issues or corresponding solutions. Accordingly, this study dealt with legal reviews primarily on product liability(PL), because it deemed necessary to appropriately construe and apply the Product Liability Act as a part of consumer redress in case of any accident caused by Genetically Modified Food(GMF). Incidentally, respective follow-up sections after Section 2, the Product Liability Act seem to provide “producer's strict liability(liability without fault) for any damage caused by defective product”, but there is a wide room that producers or parties concerned may be exempt from liabilities owing to exclusion criteria, cause of immunity and burden of proof. In this regard, it is found that the said Act still reveals its limitations of abiding by conventional legal framework of liability. Therefore, although there has been yet no case of accident caused by GMF in Korea, it is necessary to enact special laws concerning GMF, as enforced in Germany, in nearer future as a part of supplementary measures for GMO-induced accidents which may occur in unexpected timing within the socioeconomic structure of mass production and consumption.
