더욱이 난민이 연루된 테러나 각종 범죄로 인해 EU를 자유와 안전 및 정의의 지대(an area of freedom, security and justice)로 만들겠다는 계획마저 어렵게 만들고 있다.

Abstract

This article reviews the New Pact on Migration and Asylum that the EU is actively promoting. The EU refugee problem, which began as a result of the Balkan War and the political and economic crisis in the Middle East and Africa, has been addressed through various policy measures, but shows no signs of being resolved. Moreover, terrorism and various crimes involving refugees have made it difficult for the plan to make the EU a zone of freedom, safety, and justice. In addition, conflicts among member states over accepting refugees have not given the EU the leeway to stick to its current refugee policy any longer. As a result, the EU began a large-scale reform of its refugee policy, and after arduous negotiations between the Council, Parliament, and member states, the Council and Parliament finally reached a compromise on the New Pact on Migration and Asylum in December 2023. The key provisions were announced the following year in May 2024, and on June 11 of the same year, the New Pact on Migration and Asylum formally entered into force after the procedures of Parliamentary consent and Council adoption. The characteristics of the New Pact on Migration and Asylum can be defined as the integration of border management and refugee policy. The goal is to break away from the classic way of looking at the refugee issue from the perspective of human rights protection and resolve it from the perspective of a border management policy that also considers safety within the EU. Under the New Pact on Migration and Asylum, the status of refugees will change from being a special entity that undergoes separate procedures to being subject to general border inspection. In other words, all refugees must go through border inspection, and if the inspection results show that they pose a threat to national security or public order, entry will be refused, wnd and border management agencies will be able to quickly begin return procedures. The New Pact on Migration and Asylum creates new alternatives that were never found in past refugee policies, such as devising a so-called Solidarity Pool system that requires member states to make a financial contribution instead of accepting refugees. The New Pact on Migration and Asylum is now expected to completely change the paradigm of the EU's existing refugee policy and exert a significant influence not only on the EU but also on other countries grappling with refugee challenges.
