연구문제 또는 목적: 장애인 건강권 및 의료접근성 보장에 관한 권리 조례 비교 분석을 통해 광역자치단체 조례 개선안을 마련하는 것이다. 연구방법: 분석자료는 국가법령정보센터 자치법규 시스템에서 수집하였다. 분석 방법은 사회복지 조례의 내용적 체계 비교 분석 방법을 활용했다. 연구결과: 지역별로 대상자 범위, 권리성, 재정책임성, 전달체계 등에서 차이를 보였다. 분석결과 에 기반한 조례 개정 논의로서, 의료비 지원과 자치단체장의 책무성, 재정책임성에 대한 임의규정 을 강행규정으로 변경을 제안하였다. 아울러, 건강 취약계층인 장애아동을 위한 어린이 재활치료 서비스를 제공하는 광주광역시를 벤치마킹하여, 장애아동의 건강권을 보장하기 위한 조례 개정이 요청된다. 결론 또는 시사점: 광역자치단체 장애인의 건강권 증진 조례 개정 방안으로서, 의료비 지원 조항과 장애아동 건강권 증진 조항 및 의료인 장애 인식개선 사업 조항 마련을 제언하였다. 본 연구의 결과는 장애인을 위한 지역 보건의료체계 수준을 개선하고, 장애인 건강권 조례 제정 및 개정에 기여할 수 있을 것이다. 아울러, 학술적 분야에서는 장애인의 건강권 보장을 위한 법 률과 자치법규 입안 관련 논의가 활성화될 수 있을 것이라고 기대한다.
Abstract
Purpose: This study aim to derive a plan to revise Local Governments ordinances for through a comparative analysis of Ordinance of Health and Access to Medical Services for Persons With Disabilities. Method: data was collected from the National Law Information Center and analyzed using social welfare ordinances content analysis. Results: This study proposes that discretionary provisions regarding medical expense support, the responsibilities of local government heads, and financial ac- countability be revised as mandatory regulations. services for children with dis- abilities—a health-vulnerable population—this study underscores the need for ordi- nance revisions to guarantee the health rights of children with disabilities. Conclusion and Implications: As a strategy for amending metropolitan ordinances to enhance the health rights of persons with disabilities, this study proposes the estab- lishment of provisions for medical expense support, the promotion of health rights for children with disabilities, and the implementation of disability awareness pro- grams for healthcare professionals. The findings are expected to improve regional healthcare systems serving persons with disabilities and to contribute to the enact- ment and revision of related ordinances. Moreover, this research is anticipated to stimulate scholarly discourse on the legislative and regulatory frameworks necessary to secure the health rights of persons with disabilities.
