Abstract
The legal approach to economic polarization involves adjusting and overcoming economic phenomena through normative formation and interpretation. Economic polarization refers to the exacerbation of economic inequality, characterized by the extreme divergence in income and assets, reaching a maximum difference. Capital-intensive industrial structures and technological societies further deepen economic polarization. Responses to alleviating polarization include income redistribution through taxation, job provision via unemployment benefits and vocational training, and social insurance as a safety net. From an economic public law perspective, the tools to respond to polarization can be broadly divided into regulatory means and inducement means(steering means). Typical regulatory means are employed for redistribution through taxation and for addressing competitive restrictions and predatory practices in the market, while inducement means are used for income aid, subsidy provision, and social support, with various forms such as contracts rather than administrative dispositions. This allows for flexible execution of administration and has the advantage of reflecting performance and effectiveness. Regarding effectiveness, when aiming for the trickle-down effect, measures such as corporate tax reductions and investment tax credits are typically used, centered around large corporations, whereas subsidies for low-income individuals and small businesses are employed when aiming for the trickle-up effect. The constitutional basis for utilizing means to alleviate polarization includes not only Article 119 on economic provisions but also the obligation to protect and nurture small businesses outlined in Article 123, Section 3. Individual legal approaches to addressing economic polarization can be classified into four categories: first, market-regulatory approaches such as the Fair Trade Act; second, standard-setting approaches such as the minimum wage system; third, inducement administrative approaches like the Shared Growth Act; and fourth, organizational and procedural legal approaches such as the Economic, Social and Labor Council Act and the Minimum Wage Act. Addressing economic polarization is challenging to resolve solely through law. The roles of policy and law must balance each other through mutual checks and controls. To achieve this, it is essential to find intersections through interdisciplinary research between economics, society, and law.
