Abstract
The Trump administration's second term has intensified its “Make America Great Again” (MAGA) agenda, expanding trade policies to unprecedented levels. It raised steel and aluminum tariffs from 25% to 50% and extended regulations to copper and derivative products, deepening protectionism under Section 232 of the Trade Expansion Act. Beyond introducing novel tools, the administration continues to maintain and expand the use of zeroing in anti-dumping investigations, a longstanding protectionist mechanism. Despite WTO Dispute Settlement Body rulings that the current zeroing methodology, the Differential Pricing Analysis (DPA) Test, violates WTO agreements, the U.S. has persisted in its application. However, following a recent U.S. court ruling in the Marmen Inc. case, the Cohen’s d Test within the DPA Test was replaced with the Price Difference Test. This represents a minor modification to the existing methodology, but drawing from the precedent of adopting the Nails Test, the possibility of introducing an entirely new methodology cannot be ruled out. This paper proposes a new methodology that combines the “non-pattern transaction exclusion” approach explicitly permitted in the US-Washers dispute (DS464) with perspectives from the Nails Test, achieving effects equivalent to zeroing. It further derives implications for enhancing South Korea’s trade remedy system.
